Imfree is the world's first Personal Value compass that seeks out the best deals, discounts, events, content and even free mobile load based on who you are, where you are, and when you are there to navigate you to get more of the things you love most.
GENERAL TERMS AND CONDITIONS ("TERMS")
Imfree may change or amend these terms at any time. You will be prompted whenever there are updated versions of these terms. Your explicit acceptance and continued use of the Service after the date such change(s) become effective will constitute consent to the changed terms.
As a condition of your use of the Service you agree to open an Imfree account. You further agree that you are entirely responsible for any activity relating to the account and to maintain its confidentiality.
During the following events, depending on your app settings or device permissions, Imfree may collect your location information as determined through your phone’s location data: before displaying the map view, login, reward redemption, logout, and when starting a conversation, fetching new conversations, participating in a promo, fetching new promos, sending a support request, looking for a nearby store, and rating the store experience.
Imfree uses location information to customize the Service for you and others, like displaying the map view of your vicinity, sending conversations based on your location, finding nearby stores where you can redeem your offers, and securing your account when you log in or out of the app.
The Service may contain links to third-party websites which are not under Imfree‘s control. Imfree does not necessarily endorse the content available from such sites. By accessing these sites, you acknowledge and agree that Imfree is not responsible, directly or indirectly, for any damage or loss you incurred arising from or in connection with such use or interaction.
Your use of the Service shall be immediately terminated when: a) your use results in or is intended to harass, threaten, impersonate, intimidate, harm, abuse, defame, defraud; b) you upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," "affiliate links," or any other form of solicitation; c) you transmit any worms or viruses or any code of a destructive nature; d) you violate any laws applicable to your use of the Service; e) you use the Service for any illegal or unauthorized purpose; f) acts of fraud; g) you breach the provisions of the Terms; and h) you opt out of your Account Information.
A member may have one verified profile only. Subsequent access of a member having more than one profile will be cancelled.
As a member, you grant your permission for brands to have conversations with you via opting in to brands (done through tapping "ALLOW" after tapping on a brand disc in the carousel without a heart which indicates that a member is interacting with the brand for the first time).
Your Imfree account, comprising your:
- Personal Information, that includes your name, mobile number, date of birth and gender which you shared during registration;
- Profile Information, that includes your marital status, parental status and socio-economic classification determined by your educational attainment, occupation, place of residence and car ownership which you shared on our surveys;
- Behavior Information that includes in-app behavior, content engagements you complete or share as well as redemption details and all other information you have divulged or created in the course of your use of the Service will be available to Imfree.
As a Member of Imfree, Imfree grants you a revocable, non-assignable, non-transferable, non- sublicensable right to legally and ethically share the Imfree name and Imfree logo to other parties for the sole purpose of informing such third parties of the availability of the Service. Except as expressly provided in this Agreement or otherwise permitted by law, no Imfree Content may be used, copied, reproduced, modified, republished, uploaded, posted, publicly displayed, publicly performed by any means or distributed in any way via any other medium for publication or distribution or for any commercial enterprise or purpose, without Imfree‘s express prior written consent or unless provided with the ability to do so.
You also have the ability to opt out of any brand you have engaged with. By opting out of a brand, your relationship with the aforementioned will be discontinued, any further communication between yourself and the brand will cease and you may opt in to the brand again anytime you want.
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, content, and computer code (collectively, "Imfree Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel," and arrangement of such Imfree Content, contained on the Service is owned, controlled, or licensed to Imfree by Imfree Holdings Inc. (USA), and is protected by trade dress, copyright, patent, and trademark laws, and various other intellectual property rights. Imfree is not liable for brand representations whether implied or direct.

By using the Service you agree that Imfree may, at its sole discretion and without prior notice, terminate your account, your access to the Service, and/or block your future access to the Service. You understand the nature of the Service and that in its provision technical issues may arise which may affect the Service. Your use of the Service is, thus, at your sole risk and the Service is provided on an "as is" and "as available" basis. Imfree does not warrant that the Service will meet your requirements or expectations or that the Service will be uninterrupted, timely, secure, or error-free. Imfree is not liable for network connectivity (i.e. Convo delivery failure, internal/external interruptions, issues, errors).
You expressly recognize and agree that Imfree, or any of its members of the Board of Directors, Officers, Employees, subsidiaries, affiliates, agents or trustees shall not be liable for any direct or indirect damages incurred by you on account of your usage of the Service. You agree to indemnify Imfree or any of its members of the Board of Directors, Officers, Employees, subsidiaries, affiliates, agents or trustees from and against any and all liabilities and costs incurred in connection with any claim arising from your acts or omissions arising from or connected with your use of the Service. Imfree is not liable for damages related to lost load/devices/earnings, system or network malfunctions. Imfree is not liable for the value/tax transactions entered into between members and brands. No discrimination as to members or brands is recognized by Imfree.
By using the Service, you agree to the Terms and should any conflict arise from these Terms, you agree that the laws of the Philippines shall apply and that jurisdiction shall be exclusively held by the courts of Makati City, Philippines. You further agree that any claim under this Agreement must be brought within one (1) year from the occurrence of the breach, act or omission complained of, otherwise the action prescribes and can no longer be initiated.
If any portion of the Agreement is held to be invalid or unenforceable, such provision shall be stricken and the remainder of the Agreement shall be enforced as written. If Imfree does not exercise or enforce any legal right or remedy including those contained in the Agreement or arising under applicable law, this will not be taken to be a formal waiver of our rights. Imfree may assign or delegate some or all of its rights and obligations under this Agreement.
CONVO AND PROMO TERMS & CONDITIONS
Members of Imfree receive digital content or engagements (both referred generally throughout the app as "Convo"), and promotions ("Promo"). Through Convos, members’ experiences throughout the app become more personalised and contextual. When members explicitly opt in to a particular interest category or brand during or after registration, members consent to being served Convos and Promos from Imfree and/or brands based on those interest categories. By accepting the terms of this Agreement, you agree to provide accurate and authentic information when you participate in Convos and/or redeem Promos.
Imfree does not promote, or make any warranty with respect to, the products redeemed by the members.
The General Terms and Conditions governing the membership and use of Imfree and the Services are hereby incorporated by reference and shall form an integral part thereof.

What is this policy about?
This policy describes the information we process to support Imfree, other products offered by Imfree and its related tools and services, including, without limitation, our Mobile Application (“Application”), and our website at www.imfreemobile.club ("Site") (collectively "Services").
How do we get your consent?
You maintain ownership of your Personal Information and you may permanently extinguish this information on demand at any time.
Imfree does not knowingly collect information from minors nor otherwise consent to the registration of such minors for the Service. Upon being informed that a minor, without parental consent, has accessed the Service, Imfree shall immediately delete all of the minor’s Personal Information.
In addition, you provide your consent to receive relevant content and offers from our third party clients and partners by opting in to them individually. Should you wish to discontinue receiving personalized content and offers from a particular brand, you may opt out from such brand/s anytime.
- COLLECTION OF INFORMATION
What kind of information do we collect and process?
To provide the Services, we must process information about you. The types of information we collect depend on how you use our Services.
We collect Personal Information and Behavior Information in connection with our Services.
Personal Information refers to any information, whether recorded in material form or not, that will directly ascertain the identity of an individual. This may include, but is not limited to, your full name, by itself or combined with your password, mobile number, sex, date of birth, email address, metadata, and the IP address of your PC or mobile device.
Profile Information may include, but is not limited to, marital status, and your socio-economic classification, and your profile picture provided for your Imfree account.
Behavior Information is comprised of engagements and activities performed within the Services which may include, but is not limited to, your in-app behavior, the products you use, your brand preferences, your geographic location collected from a GPS-enabled mobile device and any other information you choose to submit via our Services.
Please note that the Services may provide you links to third party sites, such as links to the websites of Clients, Partners, and other third-party organizations, businesses, and merchants who have agreed to make engagements and offers available to you through our Services.
We are not responsible for the privacy policies, practices or the content of websites owned by others that you may link to or that may be linked from the Services. Accordingly, we encourage you to review the privacy policies and terms of service of those websites so that you understand how those websites collect, use and share any Personal Information.
- PROCESSING OF INFORMATION
How do we process this information?
We use your Personal Information for administrative purposes to identify you as we provide the Services to you. This may include verifying your identity to assess whether we can grant you access to the Services, responding to you when you contact us and any other activities that may require us to know you to improve the Services that we provide you, and to assess whether you are eligible for certain products and services such as vouchers, promotions, incentives, and contest prizes. We may also ask you for feedback about our products and services, so we may improve on it.
We use your login credentials and device information for data security purposes to verify your account and activity, detect and prevent fraudulent transactions (such as fraudulent load and reward redemption) and other bad experiences, and maintain the integrity of our Services.
We use your contact information to send you marketing communications, communicate with you about our Services, and let you know about our policies and terms. We also use your information to respond to you when you contact us.
We use the Profile and Behavior Information you provide, including location, preferences, interests, and in-app activities to provide personalized content that are unique and relevant to you, including, but not limited to, surveys and content (referred to as “Convos”), offers and promotions (referred to as “Promos”), and other content that we show you. We may send you emails or text messages recommending a product or service based on your personal preferences. We may also show you Promos when you use the Services.
We use your location, preferences and interests and track your in-app activities to help us and our partners to better understand you, measure the effectivity and distribution of the Convos and Promos you see, and improve the type of Convos and Promos you see in the future.
- DISCLOSURE OF INFORMATION
How is this information shared?
We work with third-party Clients and other partners who help us provide and improve our Services or who use other Imfree services to grow their businesses, which makes it possible for us to operate and provide the Services for free. We do not sell, rent, share or trade your Personal Information to third parties for their own marketing purposes unless you have granted us permission to do so.
We use your Profile and Behavior Information to provide aggregated statistics and insights that help people and businesses understand how people are engaging with Convos, Promos, products, and other content on and off our Services.
We provide our Clients and other partners with reports about the kinds of people seeing their Convos and Promos and how they are performing, but we don't share information that personally identifies you unless you grant us permission. For example, we provide general demographic and interest information to our Clients that want to engage with you through Convos and Promos to help them better understand their audience. We also confirm which Convo or Promos led you to make a purchase or take an action with a partner such as during voucher redemption.
We only provide legitimately relevant information and content to vendors and service providers who support our Services, such as providing you with load during load redemption, analyzing how our Services are used, providing customer service or conducting surveys, in order to deliver or complete a particular work order.
- OUR COMMITMENT TO YOUR RIGHTS ON PERSONAL INFORMATION
How can you access, update or delete information about you?
We provide you with the ability to access, rectify, port and erase your Personal Information. You may access and correct, if necessary, the Personal Information you provided or created in the course of your use of the Services, and other relevant information pertaining to it. You also have the ability to opt out of the brands you engaged with in the course of your use of the Services, or any changes thereto.
We store data until it is no longer necessary to provide the Services, or until you request for your aculp watchcount to be deleted, whichever comes first. When you request to delete your account, you may no longer have access to or be able to use the Services.
What are your rights?
We respect your rights to determine how your personal information can be used. These rights include:
Right to access information
You have the right to ask us for an overview of your personal information that we process.
Right to rectification
If your personal information is incorrect, you have the ability to rectify it or the right to ask us to do so. If we shared incorrect data to a third party, it is our responsibility to notify said party.
Right to object processing
You can object to Imfree using your personal data for legitimate reasons. We will consider your objection and whether processing your personal information has any undue impact on you that requires us to halt doing so.
Right to object to automated decisions
We may use internal systems to make automated decisions based on your personal information. Though you have initially provided your consent, you have the right to deny such automated decisions at any point in time.
Right to data portability
You have the right to request that Imfree Inc transfer the personal information we have collected and processed directly to you, under certain conditions.
Right to restrict processing
You have the right to ask us to restrict using your data, if:
- The personal information is incorrect.
- The personal information is being processed unlawfully.
- You have your own legitimate reasons.
Right to erasure
You may ask us to erase your personal data, if:
- You withdraw your consent for processing it.
- You have your own legitimate reasons.
- The law requires us to erase your data.
Right to file a complaint
Should you be unsatisfied with the way we have responded to your concerns, you have the right to submit a complaint to us. If you are still unsatisfied, you can escalate the complaint to the Imfree Data Protection Officer.

How do we secure the information?
We utilize reasonable information security measures to safeguard your Personal Information. Although we have physical, electronic and procedural safeguards that we believe are adequate to protect Personal Information, any such systems may be subject to human and operational error. In particular, because the Internet is an open system, we cannot and do not guarantee that the Personal Information entered by you online will not be misappropriated, intercepted, modified, deleted or used by others.
